1. SCOPE

2. INFORMATION

3. ORDER

Wine Partners undertakes to honor orders received on the Site only within the limits of available stocks of wines.
In the absence of availability of wine not indicated when placing the order, Wine Partners undertakes to inform the Customer as soon as possible. In the event that the Customer refuses any proposal from Wine Partners to deliver to it by substitution a wine similar to the price conditions of the order, any payment made by the Customer will give rise to reimbursement by Wine Partners, at the latest within a period of thirty (30) days of said payment in accordance with article L121-20-3 of the Consumer Code.
Any order will result in the sending of an order confirmation to the email address provided by the Customer, in accordance with article 1369-5 of the Civil Code and an invoice on delivery of the wines ordered to the address indicated by the Customer when ordering on the store.
4. VALIDATION OF THE ORDER
Any User of the Site who does not have a Client ID must follow a registration procedure at the Boutique Croix de Labrie allowing him to validate and obtain his Client ID. This identifier is personal. The order is validated upon payment of the full sale price of the wines ordered, by credit card or by check, in accordance with article 7 of the GTC.

5. ARCHIVING
The computerized registers, kept in the computer systems of Wine Partners under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties. It is expressly agreed that, unless there is a manifest error on the part of Wine Partners, the data stored in the Wine Partners information system have probative force with regard to the orders placed by the Customer.
Data on computer or electronic media constitute valid evidence and as such, are admissible under the same conditions and with the same probative force as any document drawn up, received or kept in writing. The archiving of orders and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with the provisions of article 1348 of the Civil Code and of article L 134-2 of the Code of Consumption.
In accordance with article 1369-5 of the Civil Code, the Customer can have access to his accepted orders and his invoices by sending an e-mail, Wine Partners agreeing to send him the requested contractual documents as soon as possible. .
6. CONTROL - QUALITY
Wine Partners reserves the right to cancel any order not delivered, in whole or in part, without any recourse from the Customer, if it considers it necessary to take this measure in the interest of the reputation of its wines. The price paid by the Customer will be fully refunded, but he will not be able to claim any compensation or compensation for any reason whatsoever.
7. PRICE
Prices are quoted in euros all taxes included. They take into account the VAT applicable on the day of the order. The prices of the wines ordered on the Site and the date of the order concerned are authentic in accordance with the stipulations of article 5 and are not subject to modification after validation of the order. Prices are exclusive of shipping costs, which are communicated to the Customer on the Shop and confirmed before validation of the Customer's order. 8. DELIVERY
The Customer has the choice of having it delivered, either at home or at another address that he will indicate on the order form. In case of return of wines for incomplete address, the Customer may choose either:

The wines are shipped within fifteen (15) working days from the validation of the order in accordance with article 4. Delivery times are increased to thirty (30) days for orders validated between December 15 and January 10 of each calendar year. If the delivery deadlines are exceeded, the Customer will inform customer service in order to ensure the effective date of delivery, without prejudice to the application of legal provisions.
Damage: From the time of removal from the cellar, Wine Partners cannot be held liable for any damage that the goods may suffer or cause for any reason whatsoever. 9. WITHDRAWAL
The Customer may exercise his right of withdrawal in accordance with article L 121-20 of the Consumer Code within fourteen (14) clear days, without having to justify reasons, from receipt of the wines ordered. This right is exercised by returning the wines to Wine Partners, only the return costs being the responsibility of the Customer. The wines must be in their original condition and packaging and returned within fourteen (14) days of delivery. No return will be accepted after this period of fourteen (14) days.
Wine Partners will reimburse the Customer who has exercised his right of withdrawal as soon as possible and at the latest within thirty (30) days following the date on which the right of withdrawal was exercised, in accordance with article L 121-20-1 of the Consumer Code.

10. GUARANTEES
In the event of a major lack of conformity of the wines delivered to the wines ordered within the meaning of article L 211-4 et seq. Likewise, Wine Partners cannot be held liable for all the inconveniences or damages inherent in the use of the Internet network, in particular a breakdown in service, an external intrusion or the presence of computer viruses.
14. INTELLECTUAL PROPERTY
All elements of the Wine Partners Site, whether visual or audio, including the underlying technology, are protected by intellectual property rights including copyright and trademarks.
